The time between filing for divorce and obtaining the final decree can be difficult as a family begins the transition toward divorce. Life goes on during that period, and decisions need to be made about finances, property and other issues. Your lawyer can help you determine what to ask for in a temporary domestic order.
- Frozen assets: After a divorce is filed, the court will issue a temporary domestic order that freezes the status quo. Both parties are ordered not to touch the assets. To interfere with marital property (sell the house, close bank accounts, change the stock portfolio) can result in breach of fiduciary duty charges.
- No abuse or intimidation: In interim orders, both spouses are instructed not to threaten or intimidate the other. If you have reason to fear physical or emotional harm, talk to your attorney about a restraining order.
- Temporary child support and custody: In interim orders, the child support guidelines are not used. The judge will determine an amount that will serve the family during the interim period. There will also be a determination of temporary custody, visitation and parenting time.
- Who will live in the house? How will the bills be paid? The judge will consider many factors including the combined incomes of the parties, temporary custody and visitation and the needs of both parties. It is important to have an attorney who can present your case in an effective manner.
